Terms of Service

1. Agreement to Terms

By registering for an account, accessing, or using Motivecho ("Service"), operated by Motivecho Intelligence Inc., you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent and warrant that you have authority to bind that entity to these Terms.

2. Description of Service & Subscription Plan

Motivecho provides automated competitive intelligence, public webpage change detection, noise-filtered diffing, and AI-assisted strategic motive decoding.

The Service is offered under a single subscription plan (Pro Intelligence). Available billing options:$49 USD per month (monthly billing) or $490 USD per year (annual billing, 2 months free), which grants:

• Monitoring for up to twenty (20) simultaneous competitors.
• Up to five (5) active monitored surfaces per competitor.
• Hourly automated crawls for high-priority commercial hubs (pricing, changelogs, homepages).
• Google Gemini AI motive decoding and sales counter-scripts.
• Access to historical snapshots and visual diff archives.
• Real-time Slack, Discord, and email notification alerts.

3. Billing, Renewal & Cancellation

Merchant of Record: All subscription billing, invoicing, and payment processing are fulfilled by our authorized Merchant of Record, Dodo Payments Inc. Dodo Payments is the merchant on your credit card statement and handles tax compliance and invoicing.

Recurring Billing: Subscriptions automatically renew at the end of each billing cycle at the original price ($49 USD/month for monthly subscribers, $490 USD/year for annual subscribers) unless canceled prior to the end of the current billing cycle.

Self-Service Cancellation: You may cancel your subscription at any time with one click via the Customer Billing Portal accessible in your Account Settings. Upon cancellation, your access remains active through the end of your prepaid period.

Refunds: Because Motivecho immediately provisions dedicated cloud browser rendering resources and continuous AI compute, payments are generally non-refundable except where required by applicable consumer protection laws or in cases of verified service disruption.

4. Acceptable Use & Crawling Policy

You agree to use Motivecho strictly in compliance with all applicable laws. You agree NOT to:

• Configure targets intended to overload, disrupt, or launch denial-of-service attacks against third-party web infrastructure.
• Attempt to bypass paywalls, authentication forms, or password-protected member areas using the Service.
• Resell, sublicense, or redistribute Motivecho raw intelligence feeds without written authorization.
• Reverse-engineer the Service or scrape Motivecho internal APIs.

5. Intellectual Property & AI Analysis Disclaimer

Ownership: You retain all rights to your account configurations and business data. Motivecho and its licensors retain all rights, title, and interest in the platform software, algorithms, and brand assets.

Advisory Disclaimer: Motivecho uses machine learning models (including Google Gemini 2.0 Flash) to synthesize competitor changes and suggest strategic counter-moves. AI outputs are provided for strategic informational purposes only. Motivecho does not provide legal, financial, or formal pricing advice. You are solely responsible for verifying competitive claims before using them in sales conversations or business decisions.

6. Limitation of Liability

To the maximum extent permitted by law, Motivecho shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Motivecho's aggregate liability for all claims arising from or related to the Service shall not exceed the total amount paid by you to Motivecho during the three (3) months preceding the incident.

7. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. Any dispute arising under these Terms shall be resolved in the competent courts of that jurisdiction.

8. Changes to Terms

We reserve the right to modify these Terms. If changes are material, we will provide at least 14 days' advance notice via email or via an in-app notice prior to the new terms taking effect. Continued use of the Service after changes constitute acceptance.
